Knoxville Court of Appeals strikes down controversial DUI law

DUI attorney Marcos Garza dropped by Channel 8 news to answer questions about the recent breathalyzer ruling in the Knoxville Court of Appeals. The current Tennessee law was deemed unconstitutional because adding an extra $250 fine to cover the cost of a blood alcohol or breathalyzer test if convicted would provide a monetary incentive for the State of Tennessee to convict someone charged with a DUI in Tennessee.
