Under Tennessee law, it is illegal to operate a motor vehicle while:

  • Your blood alcohol concentration (BAC) is 0.08% or higher, or
  • You are otherwise “under the influence” of alcohol or drugs to the extent your ability to safely drive is impaired.

This applies whether you are driving or in actual physical control of a vehicle.

Tennessee DUI Penalties by Offense

Tennessee treats DUI charges seriously. Penalties escalate significantly with each subsequent conviction within a 10-year look-back period.

Tennessee treats DUI charges seriously. Penalties escalate significantly with each subsequent conviction within a 10-year look-back period, meaning that if a person is charged with a DUI and has one or more prior DUI convictions within the past 10 years, the new charge will be treated as a second offense or subsequent offense. In rare circumstances, the lookback period can effectively extend to 20 years: if someone was convicted of a DUI that occurred within the last 10 years, the lookback period then extends to another 10 years, not to exceed 20 years.

First DUI Offense (Class A Misdemeanor)

A first DUI conviction carries substantial criminal penalties, including:

  • 48 hours to 11 months, 29 days in jail;
    • Minimum 7 consecutive days in jail if your BAC was 0.15% or higher.
  • Fines between $350 and $1,500.

  • Driver’s license suspension for 1 year.
  • Mandatory alcohol and drug assessment/treatment.
  • Ignition Interlock Device (IID) may be required at your expense upon reinstatement.

A first offense can still significantly disrupt your life — and the stakes grow dramatically with subsequent offenses.

Second DUI Offense (Class A Misdemeanor)

  • Driver’s license suspension for up to 6 years.
  • Ignition interlock requirements.
  • Mandatory substance abuse assessment and treatment.
  • Vehicle seizure/forfeiture may apply.

Other Enhanced DUI Consequences

Even beyond the standard DUI penalties, Tennessee law also imposes:

  • Enhanced minimum sentences for high BAC levels.
  • Mandatory treatment programs and community service.
  • Victim restitution and court-ordered programs.

If your case involves accidents, injuries or fatalities, the charges and penalties can escalate to vehicular assault or vehicular homicide, which are serious felonies.
