What is the difference between a DUI and DWI?

DWI stands for driving while intoxicated. A lot of states call it DUI. It is driving under the influence. They are essentially the same thing in most states. In Tennessee, there is a little bit of a distinction, because DWI is relegated for individuals under the legal drinking age. Essentially, it is an optional charge for those who are of 16 to 21 years old age, whereas DUI stands for an adult 21 years or older.

There is a gray area in between. If you are 18, 19, or 20, you could be charged with either one. Either the adult DUI or the underage driving while impaired (DWI).
