If you’ve spent any time in downtown Knoxville this summer, you’ve probably noticed something different about Market Square. People are walking around with drinks in hand  legally. That’s because the City of Knoxville officially launched its Designated Outdoor Refreshment Area, or DORA, making Market Square one of the most exciting places to enjoy a night out in East Tennessee.

But it’s important to remember that freedom comes with a very specific set of boundaries. As a criminal defense attorney who has represented Knoxville residents for over two decades, I want to make sure you enjoy this new perk without accidentally turning your fun evening into a legal headache.

What Is the Market Square DORA?

The Market Square Designated Outdoor Refreshment Area is a pilot program approved by the Knoxville City Council that allows patrons 21 and older to carry alcoholic beverages purchased from participating businesses throughout Market Square and around Covenant Health Park. The zone is bounded by Wall Avenue, Walnut Street, Strong Alley, and Union Avenue, and is active every day from 10 a.m. to 10 p.m. The other zone around Covenant Health Park is bounded by East Jackson Avenue, Floridia Street, and Stadium Way. The rules inside the DORA are straightforward:

• Drinks must be served in a can or clear cup with a special DORA branded sticker
• You cannot bring your drink into other businesses
• Your drink must be emptied and thrown away before you leave the zone

Simple enough, until you forget that last rule.

What Happens When You Step Outside the Zone?

This is where things get real. The moment you walk outside those four streets with an open container, you are no longer protected by the DORA ordinance. And if you’ve had a few drinks and an officer believes you pose a risk to yourself or others, you could be charged with public intoxication under Tennessee law.

Under the Knoxville City Code, possessing an open container of alcohol in a public place outside of the DORA is a Class C misdemeanor. The ordinance prohibits simply possessing an open container of alcohol on any public street, sidewalk, park, or parking lot.

What If You Have One Too Many?

It is still important to be responsible when drinking inside and out of the DORA zone. Rowdy, irresponsible behavior can get you in trouble when you are drinking downtown.

Under the Tennessee Code, public intoxication is a class C misdemeanor. You do not have to be stumbling or causing a scene to be arrested. The law says you can be charged if:

• You may be endangering yourself
• You are endangering other people or property
• You are unreasonably annoying people in the vicinity

A conviction for a Class C misdemeanor can result in up to 30 days in jail and a $50 fine. More importantly, it goes on your record, which can affect your job, housing, and future opportunities.

Because it is easier than you think to cross the line.
